Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for using the AI interview system (hereinafter referred to as "the Service") provided by IC Consulting LLC (hereinafter referred to as "the Company"). All users of the Service (hereinafter referred to as "Users") are deemed to have agreed to these Terms.

1. Scope of Application

  • These Terms apply when the User utilizes the Service in the manner prescribed by the Company.
  • The Company may modify these Terms as necessary. The revised Terms will become effective upon being posted on the Company's website. Users are expected to review these Terms periodically, and any continued use of the Service after such modifications shall be deemed as acceptance of the revised Terms.

2. Definitions

  • The Service: Refers to the AI interview system provided by the Company, including various features accessible through a web browser or dedicated application.
  • User Account: Refers to the information registered by the User in order to use the Service (such as email address, password, etc.).
  • Pricing Plan: Refers to paid plans related to the use of the Service, such as monthly subscription plans selected by the User.

3. User Registration

  • To use the Service, the User must register the necessary information (such as name, email address, company name, etc.) in the manner prescribed by the Company. The registration is considered complete when the Company approves the application.
  • The Company may refuse or cancel a registration if it determines that any of the following apply:
    • The registration information contains falsehoods, omissions, or errors
    • The User has previously been subject to suspension of use due to a violation of these Terms or similar reasons
    • The Company otherwise deems the registration to be inappropriate

4. User Responsibilities

  • Users shall use the Service at their own responsibility and shall be responsible for all actions taken in connection with their use of the Service.
  • Users must properly manage their account information (such as ID and password) and take strict measures to prevent unauthorized use by third parties. The Company shall not be held liable for any damages incurred by the User or third parties due to unauthorized use of a User account.
  • When using the content or features of the Service for commercial or profit-making purposes, the User must comply with the methods and rules established by the Company.

5. Prohibited Conduct

Users must not engage in any of the following acts when using the Service:

  • Acts that violate laws or public order and morals
  • Acts related to criminal behavior
  • Acts that infringe on the intellectual property rights of the Company or third parties
  • Defamation of other users, third parties, or the Company
  • Infringement of the property, privacy, or other rights of other users, third parties, or the Company
  • Actions that place an excessive load on the Service’s servers or network, or involve unauthorized access
  • Actions that may interfere with the operation of the Service
  • Acts that promote or encourage criminal activity
  • Any other actions deemed inappropriate by the Company

6. Copyright and Intellectual Property Rights

  • All content provided through the Service (including text, images, programs, etc.) is the property of the Company or of third parties who hold legitimate rights, and is protected by copyright and other intellectual property laws.
  • Users must not reproduce, repurpose, sell, modify, publish, publicly transmit, or otherwise use any information obtained through the Service in a manner that infringes upon the rights of the Company or any third party.

7. Disclaimers

  • The Company makes no guarantees regarding the content, functionality, accuracy, reliability, or fitness for a particular purpose of the Service.
  • The Company shall not be liable for any damages incurred by the User in connection with the use of the Service. However, this exclusion does not apply in cases where damage is caused by the intentional misconduct or gross negligence of the Company.
  • The Company shall not be responsible for any suspension, interruption, delay, or loss of data in the Service caused by natural disasters, war, riots, fires, power outages, communication failures, computer viruses, unauthorized access, or other such events.

8. Changes, Suspension, or Termination of the Service

  • The Company may change, suspend, or terminate all or part of the Service without prior notice to Users in any of the following cases:
    • When performing system maintenance, inspection, or updates
    • When it becomes difficult to provide the Service due to fire, power outage, natural disasters, or other force majeure events
    • When the Company otherwise deems it necessary to change, suspend, or terminate the Service
  • The Company shall not be liable for any damages incurred by Users or third parties resulting from the change, suspension, or termination of the Service as described above.

9. Compensation for Damages

  • If a User violates these Terms and causes damage to the Company or a third party, the User shall compensate for such damage at their own responsibility and expense.
  • If the Company causes damage to a User or a third party in connection with the provision of the Service, the Company’s liability shall be limited to direct and actual damages that are ordinary and reasonably foreseeable. The maximum amount of compensation shall not exceed the monthly subscription fee paid for the month in which the damage occurred. However, this limitation does not apply in cases of intentional misconduct or gross negligence by the Company.

10.  Amendments to the Terms

  • The Company may amend these Terms at its discretion. The amended Terms shall take effect from the time they are posted on the Company’s website.
  • Users are expected to regularly review the latest version of the Terms, and continued use of the Service after any changes shall be deemed as acceptance of the amended Terms.

11. Governing Law and Jurisdiction

  • These Terms shall be governed by the laws of Japan.
  • In the event of any dispute arising in connection with these Terms, the district court having jurisdiction over the location of the Company’s head office shall be the exclusive court of first instance.
